Terms and Conditions

Welcome to Bundle and Save by Hims! These terms and conditions (Bundle Terms) are between Hims Australia Pty Ltd (ACN 653 673 360) (Hims, we, us or our) and eligible patients (you or your). Subject to these Bundle Terms, the Bundle and Save program offers you a discount when you pay upfront for multiple orders of your treatment plan (Bundle Plan). By purchasing a Bundle Plan, you agree to these Bundle Terms.

A. Offer

1. Eligibility: You are eligible if a Hims practitioner recommends to you one of the treatment plans set out in Schedule 1 of these Bundle Terms (Hims Subscription) and you otherwise meet the eligibility requirements set out in the Hims terms and conditions. Recommending a Hims Subscription is at the Hims practitioner’s sole independent discretion.

2. Redeem your offer: You can select your Bundle Plan at checkout, after your consultation.

3. Calculating your upfront payment: Your upfront payment is calculated as:
   
   Upfront Payment = (Standard Price − Applicable Discount) × number of orders in your Bundle Plan
   
   In these Bundle Terms:
   

   • The Standard Price is the price typically charged at the time of purchase for one order of your Hims Subscription.

   • The Applicable Discount is the discount applied to each order, based on your Hims Subscription and the Bundle Plan you choose. 

   
   Indicative Upfront Payments, Standard Prices and Applicable Discounts are set out in Schedule 1 of these Bundle Terms.

4. Delivery: If you’re on a Bundle Plan, your orders may be delivered altogether, in batches (e.g. 3 months of orders sent as the first of 4 orders in a 12 month bundle), or individually. The typical delivery cadence for your orders is set out in Schedule 1 though this may be varied during the course of your Bundle Plan.

B. Changing your treatment stage

1. This clause B applies only to the Hims Weight Treatment Plans set out in Schedule 1, which may have multiple treatment stages based on the recommendation of your Hims practitioner.  

2. If you choose to change your treatment stage under clause B(1) of these Bundle Terms:

   1. in accordance with clause C(1)(b) below, we will refund any portion of the Upfront Payment that relates to future orders at the existing treatment stage (i.e. any order of your Hims Subscription that has not been dispensed by a pharmacy); and

   2. your Hims Subscription will continue at the new treatment stage. The Standard Price of orders differs between treatment stages and increases at each higher treatment stage. For your new treatment stage, you may choose to:

      1. start a new Bundle Plan, with the Upfront Payment now calculated on the basis of the new Standard Price for your Hims Subscription; or

      2. continue your Hims Subscription on an unbundled basis, and pay the Standard Price for each new order.

C. Refunds

1. Australian Consumer Law: You have rights under Schedule 2 of the Competition and Consumer Act 2010 (Cth) in relation to the provision of your Hims Subscription, including rights to refunds, replacements and repairs in certain circumstances. Nothing in these Bundle Terms excludes, restricts or modifies those rights, and those rights prevail to the extent of any inconsistency with these Bundle Terms.

2. Refund eligibility: Without limiting clause C(1), you are eligible for a refund of some or all of your Upfront Payment only in the following circumstances:

   1. Money back guarantee: You qualify for a refund under the money back guarantee policy set out in the Hims terms and conditions (MBG Policy). In this case, we will refund your Upfront Payment in full.
      
      Example: If, 10 days into your 3 month Bundle Plan (and otherwise meeting the conditions for the MBG Policy), you decide you no longer want your Hims Subscription, we will refund the Upfront Payment in full.

   2. Practitioner recommends a change: Your Hims practitioner recommends that you stop or change your Hims Subscription during the Bundle Period. In this case, your refund will be calculated based on the Discounted Price as follows:
      
      Refund = Upfront Payment – (Discounted Price x number of Processed Orders)
      
      In these Bundle Terms:
      

      • The Discounted Price, for each order, is calculated as the Standard Price, less the Applicable Discount.

      • A Processed Order is an order that has been dispensed by the pharmacy in preparation for it to be delivered to you.  

      
      Example: If, 4 months into your 12 month Bundle Plan, your Hims practitioner recommends you stop for clinical reasons, we deduct your first 4 months at the Discounted Price from the Upfront Payment when calculating your refund.
      
      Example: If, 2 months into your 3 month Bundle Plan, your Hims practitioner recommends you move up a treatment stage of your Hims Subscription, we deduct your first 2 months at the Discounted Price from the Upfront Payment when calculating your refund.

   3. Cancellation for convenience: You cancel your Bundle Plan for convenience, and Schedule 1 of these Bundle Terms identifies your Bundle Plan as eligible for cancellation for convenience. In this case, your refund will be calculated based on the Standard Price as follows:
      
      Refund = Upfront Payment – (Standard Price x number of Processed Orders)
      
      Example: If, 5 months into your 6 month Bundle Plan, you decide to cancel your Bundle Plan for convenience, we deduct your first 5 months at the Standard Price from the Upfront Payment when calculating your refund.  
      
      Please note that if, following cancellation for convenience, you want to continue with an unbundled Hims Subscription, you will need to attend a further review consultation with a Hims practitioner. 

3. How refunds are paid: We will pay any refund to you via the payment method you used for your Upfront Payment. Refunds usually take 5 to 10 business days to be processed.

4. No other refunds: Subject to clauses C(1) and C(2), you are not eligible for a refund of your Upfront Payment in any other circumstances.

D. General terms

1. The Bundle Program:

   1. may only be applied at the time of purchase, not retrospectively;

   2. may only be applied to one Bundle Plan at a time for each Hims Subscription;

   3. is not transferrable and may not be resold or redeemed for cash; and

   4. cannot be used in conjunction with any other offers, unless otherwise stated.

2. We may update these Bundle Terms from time to time. The Bundle Terms that apply to your Bundle Plan are those in effect when you pay the Upfront Payment, and later updates do not affect a Bundle Plan you have already purchased. However, the delivery cadence of your orders, and whether your orders are delivered separately or together, is subject to variation.

3. These Bundle Terms operate alongside our Hims terms and conditions. To the extent of any inconsistency, the Bundle Terms prevail.
